Overview
Be Artistic Club operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Be Artistic Club is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing and disclosure of your personal information.
Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read it and understand the collection, use and disclosure of your information as described here.
Australian Privacy Act
Be Artistic Club is based in Sydney, New South Wales, Australia. We handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth), in addition to any other privacy laws that apply to you where you live.
Personal information we collect or process
When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. We may collect or process the following categories:
- Contact details — name, address, billing address, shipping address, phone number and email address.
- Financial information — payment card and financial account details, transaction details and form of payment. We do not store full payment card numbers ourselves; payments are processed by Shopify and its payment providers.
- Account information — username, password, security questions, preferences and settings.
- Transaction information — items you view, add to cart, wishlist, purchase, return, exchange or cancel.
- Photos and ideas you send us — images you upload to generate artwork, and, for custom portrait requests, your reference image and the description of your idea. See "Photos You Upload" below.
- Communications with us — information included when you send support enquiries.
- Device information — device, browser, network connection, IP address and other unique identifiers.
- Usage information — how and when you interact with or navigate the Services.
Photos You Upload
Our portrait preview tool lets you upload a photo so that we can generate artwork from it. When you upload a photo, the image is sent to the Gemini API, an artificial intelligence image service operated by Google LLC, which generates the artwork. Your photo is transmitted for this purpose only.
For the instant preview tool, we do not store the photo you upload. It is not saved to our systems and is not retained once your artwork has been generated. Google processes the image under the Gemini API Additional Terms of Service, available at ai.google.dev/gemini-api/terms. We use Google's paid service, under which Google does not use your photo to train or improve its products, and logs it only briefly for the detection and prevention of misuse.
Studio previews. When you create a preview in our studio, the photo you upload is sent to our image provider to paint the preview and is never stored by us. We keep the finished painting for up to 90 days so we can check quality and improve our styles, after which it is deleted. If you go on to order, the approved artwork is kept as part of your order. We will not use your portrait in our marketing without asking you first.
If you place an order, we keep the generated artwork — not your original photo — attached to your order so that we can produce and ship your item, and reprint it or resolve a problem if one arises. We retain the generated artwork for 90 days after your order is fulfilled.
Your photo is processed on servers outside Australia. Please upload only photos of people who are happy to appear in artwork you are ordering.
When you use our design studio we may ask for your email address so you can continue creating previews. We use it to reply to you about your portrait, and to send news about new styles only if you have asked us to. You can unsubscribe at any time.
Custom portrait requests
If you send us a custom idea, this works a little differently from the instant preview tool above. We keep the photo you upload, any reference image, your description, and your name and email — along with the preview we create — so we can prepare your artwork, review it, and reply to you. Your images are processed by the same Google Gemini service, under the same terms, to create your preview. We never sell your photos or use them for marketing, and we only share them with the services that help us prepare and send your artwork. If you don't go ahead with an order, we delete your request within 90 days — or straight away if you ask us at info@beartistic.club.
You can ask us to delete artwork we hold in connection with your order by emailing info@beartistic.club.
Where we collect it from
- Directly from you — when you create an account, visit or use the Services, or communicate with us.
- Automatically through the Services — from your device, and through cookies and similar technologies.
- From our service providers when they collect or process information on our behalf.
- From our partners or other third parties.
How we use your personal information
- Provide, tailor and improve the Services — process payments, fulfil orders, manage your account, arrange shipping, handle returns, recommend products, prepare custom artwork previews and customise your experience.
- Marketing and advertising — send promotional communications and show online advertisements. You can opt out at any time. We do not use photos you upload for marketing without your separate permission.
- Security and fraud prevention — authenticate accounts, detect fraudulent or unsafe activity and secure our services.
- Communicating with you — provide customer support, reply to your custom portrait requests and maintain our business relationship.
- Legal reasons — comply with applicable law, respond to valid legal process and enforce our terms.
How we disclose personal information
- With Shopify, vendors and other third parties who perform services on our behalf (IT, payments, analytics, support, cloud storage, email delivery, printing and fulfilment).
- With Google LLC, which provides the artificial intelligence image service used by our portrait preview tool and custom portrait requests, as described in "Photos You Upload" above.
- With business and marketing partners to provide marketing services and personalised advertising.
- When you direct, request or otherwise consent to disclosure — for example, to ship you products.
- With our affiliates or otherwise within our corporate group.
- In connection with a business transaction such as a merger or sale, or to comply with legal obligations.
Relationship with Shopify
The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services. Information you submit will be transmitted to and shared with Shopify and third parties that may be located in countries other than where you reside. Third-party websites and links
The Services may link to third-party websites. We do not guarantee and are not responsible for the privacy or security of those sites. Please review their policies before sharing your information.
Children's data
The Services are not intended to be used by children, and we do not knowingly collect personal information about children under the age of majority in your jurisdiction. If you are a parent or guardian and believe your child has provided personal information, please contact us to request deletion.
Security and retention
No security measure is perfect or impenetrable, and information sent to us may not be secure while in transit. Please do not use unsecure channels to share sensitive information. How long we retain your personal information depends on whether we need it to provide the Services, comply with legal obligations, resolve disputes or enforce our policies.
Your rights and choices

International transfers
We may transfer, store and process your personal information outside the country you live in. Transfers out of the EEA or UK rely on recognised mechanisms such as Standard Contractual Clauses, unless the destination has been deemed to provide an adequate level of protection.

We may update this Privacy Policy from time to time. We will post the revised version on this page, update the "Last updated" date, and provide notice as required by applicable law.
